Do I need more than one estimate?

No. You are not required by law to obtain more than one estimate

Do I have to go to the repair shop my insurance company recommends?

No. According to the Auto Body Repair Consumer Bill of Rights, your insurance company cannot require you to go to a specific repair shop.

Can my insurance company refuse to pay the labor rate set forth in the repair estimate?

No. According to The California Department of Insurance, "(The Insurance Company) will not attempt to negotiate a labor rate lower than the rate set forth in the repair facility's estimate unless a labor rate survey has been conducted by (the insurance company) and the results of that survey provided to the Department of Insurance in accordance with Insurance Code 758."

Can my insurance company put a cap or limit on the cost of paint and materials used to repair my car?

No. The California Department of Insurance states that according to the Unfair Practices Act that some insurer's practice of arbitrarily placing "caps", or "limits" on the costs of paint and materials used in repairing insured vehicles is illegal and that some insurer's capping of labor costs for repairing auto damage is also illegal.

  • You are entitled to an estimate of repairs and a detailed itemization of repairs at completion
  • Be informed about towing coverage

What does this mean?
A crash course in the insurance language

  • Adjuster: The person who evaluates the damage caused by an accident, and determines the amount to be paid under the policy terms.
  • Claim: Notice to an insurance company that a loss has occurred which may be covered under the terms and conditions of the policy.
  • Deductible: The amount of the loss that the policyholder is responsible to pay up-front before covered benefits from the insurance company are payable.
  • Limits: The maximum amount of benefits the insurance company agrees to pay in the event of a loss.
  • Salvage: Damaged policyholder property that is legally signed over to an insurer in a loss settlement.
  • Total Loss: Damage to a vehicle to such extent that it cannot be repaired to its condition prior to the loss, or when the cost of repair is more than the total value of said vehicle.
